Terms of Use

Article 1 Purpose

These Terms of Use (hereinafter referred to as ‘Terms and Conditions’) are the user’s rights, obligations and responsibilities in using the company’s Internet homepage (www.gamgakdesign.com) provided by TOP Logistics Co., Ltd. (hereinafter referred to as ‘Company’). The purpose is to regulate.

Article 2 Definition of user

Article 3 Membership registration

  • ① Anyone who wishes to become a user must apply for membership by filling out the membership information according to the registration form set by the company and clicking the “Register” button.
  • ② The Company will register the applicant as a member as stated in Paragraph 1, unless the applicant falls under any of the following items.
    • 1. If the applicant has lost membership due to violating each provision of these Terms and Conditions. However, an exception is made if 3 years have passed since the loss of membership and the company has approved membership re-registration.
    • 2. If there are false information, omissions, or errors in the registration information.
    • 3. If it is determined that registering as a member will significantly impede the company's technology.
  • ③ The membership contract is established when the company’s approval reaches the applicant.
  • ④ If there is a change in the member information stated in Paragraph 1, the member must immediately correct and record the change.

Article 4 (Effectiveness and revision of terms and conditions)

  • ① The company posts the contents of these terms and conditions on the initial service screen of the TOP Logistics Co., Ltd. website so that members can easily understand them.
  • ② The Company may revise these Terms and Conditions to the extent that they do not violate relevant laws, such as the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Electronic Signature Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
  • ③ When the Company revises these Terms and Conditions, it specifies the date of application and the reason for revision and announces them on the initial screen of the website along with the current Terms and Conditions from 7 days prior to the date of application until the day before the date of application. However, if changes are made to the terms and conditions that are disadvantageous to members, notice will be provided with a grace period of at least 30 days.   • ④ Members have the right to refuse any revised terms and conditions. If members do not agree to the revised terms and conditions, they may stop using the service and cancel their membership registration.   • ⑤ The company is not responsible for any damages incurred by members due to lack of information about changed terms and conditions.

Article 5 Consent to use of member information

  • ① The company’s personal information handling policy applies to members’ personal information.
  • ② The company’s member information is collected, used, managed, and protected as follows.
    • 1. Collection of personal information: The company collects information provided by members when signing up for the company's services, information provided by members for community activities, information provided by members for participating in various events, and information provided by members to obtain advertisements or prizes. We collect information about members through such information.
    • 2. Use of personal information: The company does not disclose or distribute member personal information collected in connection with the provision of company services to a third party without the member's consent. However, if there is a request from a state agency pursuant to the provisions of laws such as the Framework Act on Telecommunications, if there is a request for investigation of a crime, if there is a request by the Information and Communication Ethics Committee, or if there is a request pursuant to procedures stipulated in other related laws and regulations, This does not apply if you voluntarily disclose the personal information you provided to the company.
    • 3. Management of personal information: To protect and manage personal information, you may edit/delete your personal information at any time in the member information on the website.
    • 4. Protection of personal information: Only you can view/edit/delete your personal information, and this does not involve revealing your password. Article 6 Service suspension

  • ① The Company may temporarily suspend the provision of services in the event of maintenance, inspection, replacement or breakdown of information and communication equipment such as computers, or interruption of communication, and replacement with new services or other reasons deemed appropriate by the Company. As a result, the currently provided service may be completely discontinued.
  • ② In the case of service interruption pursuant to Paragraph 1, the Company will notify users in the manner prescribed in Article 8, Paragraph 2. However, this does not apply if prior notice is not possible due to service interruption due to reasons beyond the company's control (disk failure without intention or negligence of the system administrator, system crash, etc.).

Article 7 User withdrawal and loss of qualification, etc.

  • ① Users may request the Company to cancel their membership registration (user withdrawal) at any time, and the Company will immediately take steps to cancel the user's membership registration upon receipt of the above request.
  • ② If a user falls under any of the following reasons, the company may restrict, suspend, or lose the user's membership in an appropriate manner.
    • 1. If false information is registered when applying for membership
    • 2. In case of threatening the electronic transaction order, such as interfering with other people's use of the company or stealing information.
    • 3. When using the company to commit an act prohibited by the law or these Terms and Conditions or contrary to public order and morals.
  • ③ If the company decides to revoke the user's membership, the company will cancel the membership registration. In this case, the user member will be notified of this prior to cancellation of membership registration and given an opportunity to explain.

Article 8 Notification to users

  • ① If the company notifies a specific user of matters other than the revision of the terms and conditions set forth in Article 4, it may do so through the email address provided by the company or the email address entered at the time of registration.
  • ② If the Company notifies an unspecified number of users of matters other than the revision of the Terms and Conditions stipulated in Article 4, it may substitute individual notification by posting the notice on the Company bulletin board for more than one week.

Article 9 Protection of users’ personal information

  • ① The company strives to protect users’ personal information, including user registration information, in accordance with relevant laws and regulations. Protection of users' personal information is governed by relevant laws and the personal information handling policy established by the company.

Article 10 Obligations of the Company

  • ① The Company does not engage in any acts prohibited by the law or these Terms and Conditions or that are against public order and morals, and strives to provide continuous and stable services in accordance with the provisions of these Terms and Conditions.
  • ② The company establishes a security system to protect users’ personal information (including credit information) so that users can use Internet services safely.
  • ③ The company does not send advertising emails for commercial purposes that users do not want.
  • ④ The company is responsible for compensating users for damages suffered due to the company's intention or gross negligence when using the service.

Article 11 Obligations regarding user ID and password

  • ① Except in cases where the Company assumes responsibility in accordance with relevant laws and personal information handling policies, each user is responsible for managing his or her own ID and password.
  • ② Users must not allow third parties to use their ID and password.
  • ③ If the user becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the company and follow any instructions provided by the company.

Article 12 User Obligations

  • ① Users must not perform any of the following acts.
    • 1. Registering false information when applying for or changing membership
    • 2. Changing information posted on the company
    • 3. Acts that infringe on the moral rights or intellectual property rights of the company or other third parties or interfere with business.
    • 4. Stealing another member’s ID
    • 5. Send junk mail, spam mail, chain letters, emails recommending membership in a pyramid organization, or emails containing obscene or violent messages, images, or audio, etc. Other acts of disclosing or posting information that is against public order and morals.
    • 6. Transmitting or posting information (computer programs, etc.) whose transmission or posting is prohibited by relevant laws and regulations
    • 7. Posting or sending emails by impersonating or impersonating a company employee or company service administrator, or by stealing another person's name.
    • 8. Posting or e-mailing material containing software viruses or any other computer code, files, or programs designed to disrupt or destroy the normal operation of computer software, hardware, or telecommunications equipment.
    • 9. Harassing other users, such as stalking
    • 10. Collecting, storing, and disclosing personal information about other users without their consent.
    • 11. Conducting profit-making activities using the company’s services by posting advertisements or propaganda or sending spam emails targeting an unspecified number of people.
    • 12. Violating the terms and conditions set forth in the service provided by the company or other regulations regarding service use.
  • ② If a user commits an act falling under Paragraph 1, the Company may restrict, suspend, or lose the user's membership in an appropriate manner in accordance with the provisions of Paragraphs 2 and 3 of Article 7 of these Terms and Conditions.
  • ③ The user is responsible for compensating for damages suffered by the company or other users due to reasons attributable to the user.

Article 13 Change of member information

  • ① If there is a change in member information (address, e-mail address, etc.), members must immediately notify and make corrections on the website operated by the company.
  • ② The member is solely responsible for any failure to notify or revise changes, which may be grounds for suspension or termination of the service.

Article 14 Deletion of public postings

If the content of a user's public posting falls under any of the following items, the company may delete the public posting without prior notice to the user, and may restrict, suspend, or lose the user's membership.

  • 1. Content that slanders or defames other users or third parties
  • 2. Content that disseminates information, sentences, figures, etc. that violate public order and morals
  • 3. Content judged to be related to criminal activity
  • 4. Content that infringes upon the copyrights and other rights of other users or third parties.
  • 5. Content that is judged to be in violation of other relevant laws and regulations

Article 15 Attribution of copyright and restrictions on use

  • ① Copyrights and other intellectual property rights for works created by the Company belong to the Company.
  • ② Users must not use the information obtained by using the Company for commercial purposes or allow third parties to use the information obtained through the use of the Company by copying, transmitting, publishing, distributing, broadcasting or other methods without prior consent of the Company.

Article 16 Compensation for damages

The Company shall not be liable for any damage incurred to members in connection with services provided free of charge, unless such damage is caused by the Company's gross negligence.

Article 17 Disclaimer

  • ① If the company is unable to provide the service due to a natural disaster or other force majeure, the company shall be exempt from liability for any disruption in the use of the service due to reasons attributable to users and members.

Article 18 Rules other than terms and conditions

  • ① Matters not specified in these Terms and Conditions shall be governed by relevant laws and regulations or commercial practices.

Article 19 Confirmation and payment of usage fees

  • ① Members who use goods or services provided by the company can check the monthly usage amount for goods or services provided by the company through the TOP Logistics website, and the member can select between credit card and real-time account transfer for the confirmed amount. You can pay using the method approved by the company.

Article 20 Jurisdiction

Any lawsuit arising from a dispute regarding the use of the service that arises between the company and the user will be filed in the Seoul Central District Court or a court in Korea that has jurisdiction under the Civil Procedure Act.

Supplementary provisions

These Terms and Conditions will apply from May 1, 2014, and the previous Terms and Conditions that applied as of March 1, 2005 will be replaced by these Terms and Conditions.
